| GENERAL TERMS
DEFINITIONS: I understand that the term Pearlstone and Adamah as used in this document means and includes all current and former officers, directors, employees, agents, contractors, and affiliated or related entities of Pearlstone and Admah; the term “I” means and includes any participant 18 years or older, or the parent or legal guardian of any participant who is younger than 18 years of age; and the term “program” means the Pearlstone program in which a participant has enrolled or joined.
PAYMENT OF BALANCE: Balances are due 30 days before the start of the program. I agree to pay my remaining registration balance by that time, including having my card on file be charged. I agree that any balances that I incur after the 30-day period, or during or after the event will be paid in full, and that my card on file may be charged for these balances.
EMERGENCY: I agree to follow all instructions and protocols set forth by Adamah staff or its partners, and I will be solely responsible for any personal injury to myself or others or property damage resulting from my failure to follow any such instructions.
ACCIDENT: In case of accident or illness that results in my inability to consent to treatment, I hereby authorize a representative of Adamah or its partners to use his/her judgment in obtaining immediate medical care for me until such time as my emergency contact or other appropriate party can be reached. Adamah and its partners will not be responsible for any costs incurred as a result of such emergency medical treatment.
CODE OF CONDUCT: All participants at Pearlstone are responsible for their conduct and must be willing to abide by the guidelines established for the program in order to participate. The general guidelines for conduct are: 1) Participants must take responsibility for their safety by carefully listening to rules and following instructions. Unsafe behavior, failure to follow instructions, or extremely disruptive behavior may result in dismissal from the program. 2) Use and/or possession of weapons, firecrackers, drugs, alcohol, tobacco, matches, lighters, or other items deemed dangerous is strictly forbidden. 3) Participants may not damage Pearlstone property or the personal property of others. 4) All participants must wear closed toed shoes while on the farm, protect themselves from the sun, drink an appropriate amount of water, walk and not run, only use tools that have been instructed to use and will do so in a safe manner, only enter the kitchen or animal pens if instructed by Pearlstone staff. 5)Comply with all local and applicable laws and regulations during the Program.
LIABLITY
ACKNOWLEDGMENT AND ASSUMPTION OF RISKS: I understand that by participating in this Program, the participant may be exposed to a variety of risks and hazards, foreseen or unforeseen, which cannot be eliminated without fundamentally altering the unique character of the program. These inherent risks include, but are not limited to, risks and hazards including animals such as insects and spiders, and tools, such as shovels and rakes; activities vary from program to program, and may include shoveling, using a wheelbarrow, hammers, and sharp metals. Possible injuries and illnesses include, but are not limited to, sunburn, heatstroke, dehydration, musculoskeletal injuries, and other mild or serious conditions or injuries. I understand that this description of the risks involved is not complete, and that other unknown or unanticipated risks may result in property loss or injury.
Covid-19 specifically and other contagions and viruses more generally, have created additional risk at all events and gatherings, and public officials and/or venues have created policies, guidelines, and practices to limit possible exposure. I fully understand and appreciate the risks involved and voluntarily assume the risk. I agree to comply with all policies, rules, and guidelines established by public health officials, state and local governments, and by the event venue, and will act at all times while on Pearlstone property in a manner that mitigates these risks.
As a condition of participation in the program, I agree to assume full responsibility for all the risks that such participation may entail. Participation in this program is entirely voluntary, and I elect to participate with full knowledge of the inherent risks.
RELEASE AND INDEMNIFICATION: In consideration of participation in the program and the services and amenities provided by Adamah I voluntarily agree to (1) release, discharge, and hold harmless Adamah, to the fullest extent permitted by law, from any and all claims, demands, damages, losses, or liabilities, including, but not limited to, claims for personal injury or death, even if caused by the negligence of Adamah (but not its willful or wanton misconduct), arising out of or in any way connected to the program or my participation in the program; and (2) indemnify and defend Adamah, to the fullest extent permitted by law, from and with respect to any and all claims, demands, liabilities, damages or costs, even if caused by the negligence of Adamah (but not its willful or wanton misconduct), arising out of or in any way connected with the program, or participation in the program, or occurring during the inclusive dates of attendance at the program, and/or from any medical treatment received during the program.
CANCELLATION
CANCELLATION POLICY: For most programs at Pearlstone, the cancellation policy is: 31 days or more – fully refundable less a $75 fee per person (for Pesach – 61 days prior); 15-30 days prior – 50% refundable (for Pesach – 31-60 days prior); 14 days or fewer – not refundable (for Pesach – 30 days or fewer).
If you are sick with a communicable disease such as Covid-19 and are unable to attend, you may receive a credit (less $75 per person) valid through the end of the of the following calendar year towards a future retreat at either Isabella Freedman or Pearlstone. You must provide medical documentation attesting to your illness in order to receive this credit.
Pearlstone reserves the right to cancel any program at any time. This includes cancellations due to inclement weather if, in our judgment, we are unable to operate safely. In the event of such a cancellation, a full refund will be issued. If the program proceeds as scheduled, no refund will be offered.
We recommend purchase travel insurance in the event that you need to cancel or change your travel plans.
SHUTTLE AND TRANSPORTATION FEES: A full transportation refund is available if you cancel a transportation reservation at least 3 days (72 hours) prior to the official start date of a program. No refund is available if you cancel within 72 hours of the program
PUBLICITY
PHOTO RELEASE: Pearlstone and persons designated by it may use my or my child’s photograph, or any video, writing, artwork and/or testimonials created by my child and submitted to Pearlstone. It shall become the property of Pearlstone, and may be used by Pearlstone, at its discretion, for its own marketing and/or development purposes, and I hereby consent to and authorize such use without restriction. By agreeing, I consent to the following publicity release for myself and all minors for whom I am registering at this time. If I do not wish not to consent to this policy, I understand that I must email data@adamah.org, with "PHOTO WITHHOLD" as the subject line, and make sure that I receive a confirmation notice stating that we have received your request.By signing this document, I give permission both a) to Adamah and its programs (including Pearlstone, Isabella Freedman, Adamah Detroit, Jewish Youth Climate Movement, and others) and b) to The Associated: Jewish Community Federation of Baltimore, and its constituent agencies and programs, of which Pearlstone is included, to use any photograph, likeness, audio recording, video recording and/or depiction of me, and/or my name, to promote Adamah and The Associated and its agencies and programs, in all media now known or hereafter developed, including print, electronic and/or digital media, such as brochures, advertisements, annual reports, social media and Internet websites.
AGREEMENT: I have had the opportunity to ask Pearlstone any questions I may have about the Program in which myself and/or my child is a participant, and any questions have been answered to my satisfaction. I understand that this document is intended by Pearlstone to have as broad an effect as the law permits, and that if any part of this document is found to be invalid for any reason, the remainder of the document shall remain valid and fully enforceable. I have carefully read and I understand this entire document, and I am signing it voluntarily. A parent or legal guardian must sign to reflect the parent’s understanding and agreement, for themselves and on behalf of the child, to the provisions of the definitions, acknowledgment and assumptions of risks, consent to medical treatment, release and indemnification, other provisions, and agreement
CERTIFICATION: I certify that I am 18 years of age or older and that I have carefully read the above policies. I hereby acknowledge, understand and agree to the above policies as they relate to myself and members of my family, including minors, whom I am registering. |
